Release and Waiver

Every participant in Motorcycle Tours Puerto Rico is required to accept and sign a Rental Agreement and release and waiver form of rights before the guided tour begins. Motorcycle Tours Puerto Rico cannot accept any tour participant without a duly signed release and waiver form. Our agents can provide a copy of the release and waiver form.

Agents and Representatives

Motorcycle Tours Puerto Rico agents are representing us, but are not a party of this contract, nor are they in any event responsible or liable for any failure to provide any services as may be described in our literature pertaining to the contract.

Motorcycle Rental

Rental motorcycles are provided as part of the tour package. The motorcycles listed are the current motorcycle models available via Motorcycle Tours Puerto Rico, colors can vary.

All motorcycle models will have top panier bags for luggage. Motorcycle Tours Puerto Rico reserves the right to substitute the motorcycle confirmed to tour participants. Unfortunately, at times, certain unexpected and uncontrollable situations arise which may require the substitution of a motorcycle. This includes, but is not limited to, delay in fleet delivery, mechanical failure, collision damage and theft. Should Motorcycle Tours Puerto Rico not be able to provide the confirmed motorcycle a similar model will be provided to the Client. This constitutes the maximum liability of Motorcycle Tours Puerto Rico.

Security Deposit / Damage Insurance Fee

Motorcycle Tours of Puerto Rico requires a $1,000 damage deposit per motorcycle rented for the Self-Guided Daily Rental and for the 8 Hour Guided Tour. The damage deposit will be refunded in full to the participant upon the return of the undamaged motorcycle after the completion of the rental. If the motorcycle shows signs of damage, the damage deposit will be used as an insurance deductible to be withheld by Motorcycle Tours PR to cover the damages.

Motorcycle Tours of Puerto Rico offers an option to all riders on overnight tours between a $2,000.00 refundable damage deposit and a $300.00 nonrefundable full cover damage insurance. The damage deposit option will be refunded to the participant upon the return of the undamaged motorcycle to the tour operator after the completion of the trip. If the motorcycle shows signs of damage, the damage deposit will be used as an insurance deductible to be withheld by the Motorcycle Tours PR to cover the damages.

Damages excludes reasonable wear and tear. Minor blemishes caused by gravel, stones and insects are considered reasonable wear and tear. Damages or scratches caused by a driver accident, or dropping a motorcycle while riding it is not considered normal wear and tear.

Price of Tour Includes;

For 4 DAY / 3 NIGHT TOUR, 7 DAY / 6 NIGHT TOUR and 8 Hour Guided Tours the following is included;

For Daily and Multiple Day Self-Guided Rentals the following is included;
  • Late model BMW Motorcycle
  • Safety Gear rental at extra fee upon request

  • Unlimited Mileage

  • Food, snacks, beverages (Included with the 8 Hour Guided Tour only)

  • Cost for replacement of lost or stolen motorcycle keys or replacement of any bike equipment
  • Damage Insurance. (For overnight tours there is an option between a $300 full damage waiver fee and a $2,000 refundable deposit when the bike is returned undamaged.
  • Damage insurance is NOT available for the Self-Guided Daily Rentals nor the 8 Hour Guided Tour

Baggage

Motorcycle Tours PR assumes no responsibility for loss, damage, or delay in delivering baggage to tour participants. Baggage insurance is recommended.

Minimum Tour Participants (For Overnight Tours Only)

Up to 30 days prior to the start of a tour, Motorcycle Tours PR can cancel it if an insufficient number of tour participants have booked and fully paid by that time. The minimum number of participating motorcycles is 4 (four) to conduct a guided tour. For a lesser number of participating motorcycles we can offer a customized tour quote which will reflect a price adjustment.

Client Cancellation and Refunds for Overnight Tours

Cancellations received more than 60 days prior to departure will be subject to a $1000 per booked motorcycle cancellation fee. Cancellations received less than 60 days prior to departure will be subject to the following forfeit of tour cost:

  • 60 – 31 Day Cancellation Notice: 60% of Total Booking Amount
  • 30 or Less Day Cancellation Notice: 100% of Total Booking Amount
  • No Show: 100% of Total Booking Amount

Cancellation Fees will be charged to your Credit Card. Exceptions to this policy cannot be made for any reason. Trip cancellation insurance is strongly recommended.

Client Cancellation and Refunds for 8 Hour Guided Tour and Daily/Multiple Day Self-Guided Rentals

Cancellations received more than 48 hours prior to departure will be subject to a 100% refund per booked motorcycle. Cancellations between 24-48 hours prior to departure will be subject to the following forfeit of tour cost:

  • 24-48 Hours Cancellation Notice: 50% of Total Booking Amount
  • 24 Hours or Less Cancellation Notice: 100% of Total Booking Amount
  • No Show: 100% of Total Booking Amount

Cancellation Fees will be charged to your Credit Card. Exceptions to this policy cannot be made for any reason. Trip cancellation insurance is strongly recommended.

Customer Orientation

Every client will receive a full orientation to the motorcycle. The client orientation will cover all aspects of safe motorcycle operation, the clients’ maintenance responsibilities, local and state laws.

Puerto Rico Motorcycle Laws 2015

Use of helmet, gloves, boots that cover the ankles, and long pants.

Between 6 p.m. and 6 a.m., riders and passengers must wear a reflective vest.

Riders must be 18 years of age, and passengers must be at least 12.

The law adds motorcyclists to the list of school bus drivers, truck drivers, and heavy equipment operators who are subject to a legal blood-alcohol limit of 0.02 percent, instead of the 0.08 percent limit applied to car drivers.

The law prohibits lane-sharing.

Valid motorcycle riding endorsement is required for each rider.

Insurance

Motorcycle Tours PR requires that all participants purchase adequate travel, health and accident insurance as well as trip cancellation insurance prior to tour start. The coverage must be valid for the duration of the tour/rental.

The agreement between Motorcycle Tours PR and the buyer does not include coverage for injury, personal property, or damage as the result (but not limited) of negligence such as illegal use of motorcycles while under the influence of drugs, alcohol or reckless driving. A Police Report is required for all damages or accidents. All damages to motorcycle without a police report is considered Renter’s fault.

Storage

Motorcycle Tours PR will provide storage for client luggage, airline tickets, and other valuables free of charge, however at clients’ risk.

Rental Confirmation and Credit Card Deposit

With your signature on the Tour Confirmation & Credit Card Deposit Agreement Form you accept these terms and conditions as a binding contract between Motorcycle Tours PR and you, the participant. Please read them carefully. Motorcycle Tours PR cannot accept any tour participant without a duly signed Tour Confirmation & Credit Card Deposit Agreement Form and Tour Agreement.

Reservation and Payment

A 100% cost booking deposit is required at the time of booking, the deposit is subject to the cancellation policy. By signing the Credit Card Authorization you give Motorcycle Tours PR permission to charge your card at the moment of checkout. If in case of payment by wire transfer or check, the tour will only be confirmed when the payment reflects in our account.

ALL wire transfer fees are to be paid by customer

Reservations can be made only by:

ALL RESERVATIONS ARE ON A REQUEST BASIS. BOOKINGS MUST BE CONFIRMED by Motorcycle Tours PR TOUR DEPARTMENT.

Complaints

Please bring any complaints to your tour guides immediate attention. Do not wait until the tour is over; we take customer complaints very seriously and will address problems immediately.

Daily Rentals and Tour Cancellation 

Cancellation Policy: Motorcycle Tours Puerto Rico reserves the right to cancel, change or substitute any service for reasons beyond our will, possibilities and/or if any participant behaves recklessly.

In the case of cancellation due to force majeure or lack of participants, Motorcycle Tours PR will refund the deposited payment in full, which will constitute the full settlement. Motorcycle Tours PR is not liable for any additional costs or losses incurred by the tour participant due to Motorcycle Tours PR cancellation of the tour.

Daily Rentals and Tour Requirements

  • Valid motorcycle operator’s license
  • Minimum of one year of riding experience on heavyweight motorcycles.

 

Non-observance of traffic laws

If the customer does not comply with traffic laws or the requirements for safe group travel, Motorcycle Tours PR may cancel the contract and the motorcycle will be secured at the participant’s expense.

Responsibility

Motorcycle Tours PR is responsible for providing the services listed in the tour description according to the local standard and the accurate description of services offered in its literature. Motorcycle Tours PR is selecting carefully and is constantly checking its contractors, such as hotels and restaurants but stresses that these contractors are independent operations that could commit mistakes and errors. Motorcycle Tours PR is not responsible or liable for any accidents and cannot be held liable in any way for any occurrence in connection with the operation or the client’s participation in connection with the tour, which might result in injury, death or other damage to the client, his property, or his family, heirs, or assigns. Motorcycle Tours PR is not responsible for any delays, changes, in schedule or other conditions.

Tour Guides

Your tour guides are prepared to guarantee you a stress-free vacation. Please listen carefully to your guides instructions at the beginning of the tour. Your guide will and has to adjust to the weakest rider in your group. It is impossible to meet everyone’s needs and wishes; you will have the opportunity to gain as much independence on your tour as possible.

Alterations to tour schedule

Tours operate on human and natures condition basis and where variances and conditions cause changes in the tour routing and accommodations, the itinerary will be adjusted accordingly and alternate hotels, restaurants and roads will be used.

Weather conditions

Motorcycle Tours PR cannot be made liable for unpleasant and unsuitable weather conditions and no refunds are made for such conditions.

Tour Rates, Rental Rates, and Motorcycle Costs

Fares quoted in this brochure are those in effect at time of printing. If cost factors, including but not limited to hotels, meals, motorcycles, insurance, international currency fluctuations, etc. dictate the need for fare increases Motorcycle Tours PR may do so at any time prior to 60 days before departure. A fare increase is not expected to happen, however if it does the Client has the right to receive full refund if so desired.

Limitation of Liability

Motorcycle Tours Puerto Rico does not endorse or recommend any particular hotels. Reasonable care has been taken that the content of this web site is correct but it is subject to amendment at any time without notice. All content on this web site is published in good faith but YOU ACKNOWLEDGE THAT MOTORCYCLE TOURS PUERTO RICO, AS A BOOKING AGENT, CANNOT FULLY CHECK AND WILL NOT BE RESPONSIBLE FOR THE ACCURACY OF ALL INFORMATION PROVIDED BY HOTELS. Motorcycle Tours Puerto Rico does not have access to complete room availability records at each hotel. If a hotel does not have rooms available for immediate booking through Motorcycle Tours Puerto Rico, then our allocation of rooms at the contracted rate may be sold out.

Although Motorcycle Tours Puerto Rico takes reasonable care to ensure that published descriptions are correct, it is only a booking agent service and does not own or operate hotels. Motorcycle Tours Puerto Rico ACCEPTS NO LIABILITY FOR ERRORS OR OMISSIONS IN THE DESCRIPTION OF HOTELS ON THE WEB SITE. Motorcycle Tours Puerto Rico reserves the right to change your hotel booking to one of at least comparable standard and to notify you of such change as soon as possible after it occurs. No compensation is payable for such changes. In extreme circumstances Motorcycle Tours Puerto be forced to cancel your booking in which case you will be notified of such change as soon as possible, a full and prompt refund will be made and Motorcycle Tours Puerto Rico will not be under any further liability to you or your party.

MOTORCYCLE TOURS PUERTO RICO SHALL NOT BE LIABLE FOR INJURY, DAMAGE, LOSS, ACCIDENT, EXPENSE, DELAY OR IRREGULARITY DUE TO ACTS OF OR DEFAULT BY ANY HOTEL, CARRIER OR OTHER COMPANY OR PERSON PROVIDING OR RENDERING SERVICES INCLUDED IN THE BOOKING.

Hotel Sleeping Accommodation:

Upon check ins You MUST provide original valid photo identification document (national registration identity card, passport, driver’s license or other identification card or document as the Hotel may require).

Motorcycle Tours Puerto Rico is responsible for providing the room(s) stated in the Booking Confirmation(s) and according to these Terms and Conditions. We do not accept any liability for failure to provide the services contracted or any of them due to circumstances beyond our control.

To the extent permitted by law, Motorcycle Tours Puerto Rico do not accept any liability arising out of any occurrences beyond its control including but not limited to acts of terrorism, acts of God, flood, war, strikes, riot, theft, delay, cancellation, civil disaster, government regulations or changes in itinerary or schedule.

All activities have inherent risks to health and safety and Motorcycle Tours Puerto Rico will not be responsible for any eventualities related to any activities or services booked through the Motorcycle Tours Puerto Rico Website or during your stay at a Hotel.

Motorcycle Tours Puerto Rico will not be responsible for any loss or damage of property left in Guest’s room and/or the Hotel property at all times. Guests are advised to obtain insurance to cover curtailment, and loss of luggage, personal effects, damages, personal injury and money/valuable belongings.

Food and Beverages: We are not responsible for and assume no liability for any Food and Beverage provided by Motorcycle Tours Puerto Rico and their Partners. Partners are independent entities and we are not responsible for the nature or quality of products or services provided by any Partners, nor for any solicitation or marketing efforts by any Partners.  You are responsible for complying with Partners terms and conditions, and privacy and usage policies.  We are not responsible for and assume no liability for the terms, changes or discontinuances of Partners’ terms, conditions, privacy and usage policies, products or services.

Food served at the Hotel is prepared in a restaurant and not a factory setting. Whilst every attempt is made to ensure that Guests are fully informed as to the ingredients that dishes contain, the Hotel and Motorcycle Tours Puerto Rico are unable to guarantee that food will be free from specific allergens and as such any food served by the Hotel is consumed at the Guest’s own risk.

These Guest Terms are governed by the laws of Puerto Rico and each party irrevocably agrees that the courts of Puerto Rico shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).

Conflict Between English Text and Other Language Text

If there is any conflict or discrepancy between the English text of these Terms and Conditions and any translation thereof into any other language, the English text shall prevail.
